Canada’s Supreme Court recently declared that, should the federal govern-ment wish to proceed with same-sex marriage legislation, it should be encumbered only by its own fear of controversy–not by any constitutional constraints. This step toward same-sex marriage in Canada stands in sharp contrast to recent developments on the same issue in the United States, where constitutional bans on same-sex unions were favoured on November 2 by voters in 11 states (including two blue ones, Michigan and Oregon).
